A gift as an inducement to use a real estate agent's services does not, "authorize a principal broker to give any type of inducement that would violate the underwriting guidelines that apply to the loan for which a borrower has applied." This is where the problem occurs, most underwriters will not allow a gift card or other gift (other than to be used towards closing costs) to be given at or after closing. If a gift is given to a buyer without the lender or seller knowing about it, then it is illegal.

Yes. According to the Utah Division of Real Estate Administrative Code R162-6 section 62.2.12, "Gifts and Inducements. A gift given by a principal broker to a buyer or seller, lessor or lessee, in a real estate transaction as an inducement to use the services of a real estate brokerage, or in appreciation for having used the services of a brokerage, is permissible and is not an illegal sharing of commission."

 

 

 

1. Compete and fax back the Exclusive Buyer-Broker Agreement and the Buyer Rebate Terms & Conditions. Click here for instructions on how to fill out the Exclusive Buyer-Broker Agreement.

 

2. Speak with Jeff Morgan of Academy Mortgage to get pre-qualified/approved for your loan. This is a very important step to determine home much you can afford and to ensure you are looking at homes within your price range. Begin the loan process now.

 

3. After determining your needs, I will search for homes that match your purchase criteria. I will then set you up on a daily email listing notifier. You will begin to narrow down your potential homes to a reasonable number (generally around 8 homes). Once you have narrowed down your list, please drive by and personally preview the exterior of the homes. Eliminate any homes that no longer interest you.

 

4. I will arrange to preview the interiors of any homes that remain on your interest list. Once you have found the right home I will represent you through the home purchase processs. Remember: Do not contact the listing agent directly as this will VOID your rebate! I must set any appointments to view the home. The same applies to purchasing new construction. I must accompany you to the first visit to the builder.
